Runtime Terms of Use

1. Provider and contact

Runtime is an app for running with friends. It is provided by LA Digital Ventures UG (haftungsbeschränkt), Altensteinstraße 40, 14195 Berlin, Germany, represented by its managing director Luca Anzaldo, registered with the commercial register of the Local Court of Charlottenburg under HRB 275785 B ("Runtime").

For any question, report or complaint, you can reach Runtime at hallo@getruntime.de or through the contact form on getruntime.de. This address is also the single point of contact for users and for authorities, the European Commission and the European Board for Digital Services under Articles 11 and 12 of the Digital Services Act (DSA). You can write to Runtime in German or English; a person will reply.

2. Who may use Runtime

  1. Runtime is free and shows no ads.
  2. You must be at least 16 years old. By signing up, you confirm that you are.
  3. Each person has one account. You sign up with your own email address and do not pass your account on to others.
  4. Runtime is in beta. Features may change or be removed, and the service may at times be unavailable. There is no right to particular features or to a particular availability.

3. What you share and who sees it

  1. Runs are seen only by your friends, that is, people whose friend request you accepted or who accepted yours. What they see of a run (map, pace, time of day, photo and more) is up to you under "Visibility". If you tag someone on a run, that person sees the run too.
  2. Your profile – username, display name, profile picture and banner – is seen by everyone signed in to Runtime, for example when they find you through search. You can turn search off under "Findable by username"; you can still be reached through an invite link or QR code.
  3. You keep the rights to your photos, texts and runs. You allow Runtime to store and process them and to show them to the people allowed to see them under your settings, free of charge and only as far as running Runtime requires. This permission ends when you delete a piece of content or your account.
  4. Only share content you have the necessary rights to. If a photo shows other people recognisably, you need their consent.

How Runtime processes your data is set out in the privacy policy.

4. What is not allowed on Runtime

  1. Illegal content, for example insults, threats, incitement to hatred, depictions of violence, pornographic content, content that endangers children, and content that infringes the copyright or personal rights of others.
  2. Photos on runs must not show nudity, violence or advertising, nor recognisable people without their consent.
  3. Names, usernames and run titles must not insult, advertise, contain links or pretend to be someone else.
  4. Profile pictures and banners follow the same rules as photos.
  5. Conduct: Do not harass anyone, including with repeated friend requests or tags. Do not create accounts automatically or in bulk, and do not try to get around suspensions, blocks or other people's visibility settings.
  6. Reporting: Do not knowingly misuse the report function, for example to harm others.

5. Reporting and blocking

  1. In the app, you report a run or a profile through "…" → "Report" and choose a reason. For illegal content, you state why it is illegal and confirm that your information is accurate and complete to the best of your knowledge. You stop seeing the reported run, profile picture or banner at once.
  2. Without an account, you report content through the report form on getruntime.de or to hallo@getruntime.de, with your reasons, where the content is (for example a username or link), your name and email address, and a confirmation that your information is accurate and complete to the best of your knowledge.
  3. Runtime confirms receipt of a report. Every report is reviewed by a person, without automated detection or decisions, carefully and usually within 24 hours. You learn about the decision by email, together with your options to challenge it (section 7). The reported person does not learn who reported them, unless this is strictly necessary for their rights.
  4. You can block anyone through "…" → "Block". You then no longer see each other's runs or profiles and cannot find, request or tag each other; a friendship, tags and likes between you end. The blocked person is not notified. You can lift a block at any time under Settings → Blocked; friendship, tags and likes do not come back.

6. What Runtime can do about violations

  1. If content breaks the law or these terms, Runtime can remove or reset it, for example delete a photo or replace a display name with the username.
  2. For serious or repeated violations, Runtime can suspend an account temporarily or permanently and, in particularly serious cases, delete it.
  3. Runtime chooses the mildest measure that is sufficient and takes into account the rights and legitimate interests of everyone involved, including freedom of expression.
  4. You will be told about any such measure by email at the latest when it takes effect: what Runtime did, why, on what basis (law or section of these terms), whether a report or Runtime itself gave rise to it, and how you can challenge it.
  5. If content suggests a criminal offence that threatens people's life or safety, Runtime informs the competent authorities (Article 18 DSA).

7. How you can challenge a decision

  1. With Runtime: Reply to the email with the decision or write to hallo@getruntime.de. A person reviews the decision again and replies to you.
  2. With the regulator: You can complain to the Bundesnetzagentur, Germany's Digital Services Coordinator, if you believe Runtime breaches the Digital Services Act.
  3. In court: You can go to the ordinary courts at any time.

8. Deleting your account and ending use

  1. You can delete your account at any time: by email to hallo@getruntime.de from the address of your account. Runtime then deletes your profile, runs, photos, friendships and tags on its servers. Anything still on your device is removed when you delete the app.
  2. Runtime can end your use with 30 days' notice, for example if the service is discontinued, and without notice for serious violations under section 6. Before that, you can request your data.

9. Running, health and liability

  1. You run at your own risk. Runtime gives no medical advice; goals, pace zones and other figures are a guide, not training or health advice. While running, watch the traffic, not the app.
  2. Routes, distances, times and elevation are based on your device's GPS and sensors and may be inaccurate.
  3. Runtime is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, Runtime is liable only for breaches of duties whose fulfilment makes using Runtime possible in the first place and on which you may rely, and then limited to the foreseeable, typical damage. Otherwise, liability is excluded.
  4. Runtime is not responsible for other users' content as long as it does not know of illegal content; once it learns of it, it acts under sections 5 and 6.

10. Changes to these terms

Runtime may change these terms, for example when new features or laws require it. Runtime will tell you about material changes at least 30 days in advance in the app or by email. If you do not agree, you can delete your account before then; if you keep using Runtime afterwards, the new terms apply.

11. Final provisions

  1. German law applies. If you live in another EU country as a consumer, you keep the protection of that country's mandatory consumer law.
  2. Runtime is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
  3. If any provision is invalid, the others remain valid.
